Introduction
These Terms and Conditions (the “Terms”) govern your use of all software products and services offered by Jacked Up Software (“Jacked Up Software”, “we”, “us”, or “our”). Jacked Up Software provides both free and paid software solutions. By accessing or using any of our products, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our products.
Third-Party Platforms
Some Jacked Up Software products are distributed through external platforms, such as the Unity Asset Store, Itch.io, SideQuest, or other marketplaces. Purchases on those platforms are subject to the terms and policies of the respective platform, including their refund and license policies. We make no guarantees and disclaim responsibility for the policies of third-party platforms. For example, Unity Asset Store’s license clarifies that assets are licensed to the user, not sold.
Payments and Refunds
Jacked Up Software does not currently sell products directly through our own website or store. All current purchases of our products are made through third-party marketplaces. If we offer direct sales or subscriptions in the future, any refund or return policy will be clearly stated at the time of purchase. For purchases through external storefronts, the refund policy of that platform applies. For example, itch.io allows requests for refunds when the software is defective or misrepresented.
Licenses
All Jacked Up Software products are protected by software license agreements. When you acquire a product through a platform like the Unity Asset Store, the platform’s end-user license agreement (EULA) governs your use of the product. Unity’s EULA specifically notes that assets are licensed, not sold. For products obtained directly from us (outside of a platform with its own EULA), Jacked Up Software grants you a limited, non-exclusive, non-transferable license to use the software as permitted by these Terms.
Future Features and Accounts
We may introduce additional features in the future, such as user accounts, community features, or subscription-based services. If and when new features are added, we will update these Terms accordingly and notify users of any new terms or requirements. Until such features are released, they are not available, and these Terms apply only to the services currently provided.
No User-Generated Content
Currently, Jacked Up Software does not accept or host any user-generated content (UGC). All content in our software is created by Jacked Up Software or its licensors. If user-generated content features are enabled in the future, they will be governed by separate policies and incorporated into an updated version of these Terms.
Intellectual Property
All intellectual property rights (including copyrights, patents, trademarks, and trade secrets) in Jacked Up Software products and content are owned by Jacked Up Software or our licensors. No rights are transferred to you except for a limited license to use the software as granted herein. You may not copy, modify, distribute, sell, or create derivative works of our software without express permission.
Disclaimer of Warranties
- All software and related documentation is provided “as is” and “as available”, without any warranties of any kind.
- To the fullest extent permitted by law, Jacked Up Software and its licensors disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not guarantee that our software will be error-free, uninterrupted, secure, or free of viruses or other malicious code.
Limitation of Liability
- To the fullest extent permitted by law, Jacked Up Software and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of our software, even if Jacked Up Software has been advised of the possibility of such damages.
- In no event will Jacked Up Software’s total liability exceed the amount you paid, if any, for the specific software product at issue, or one dollar (if we have not charged you), except where such limitation is prohibited by law.
Changes to These Terms
We reserve the right to modify or update these Terms at any time, at our sole discretion. Changes will become effective immediately upon posting of the updated Terms on our website. Your continued use of our software after changes are posted constitutes your acceptance of the updated Terms.
Governing Law
These Terms are governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law rules. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.
